Court Rejects Marry Mubaiwa’s Appeal for Stay of Prosecution in VP Constantino Chiwenga Case
It never rains but pours for Marry Mubaiwa, the ex-wife of Vice President Constantino Chiwenga, as her bid for a permanent stay of prosecution was dismissed by the court.
Marry Mubaiwa, who is facing allegations of attempting to kill Vice President Chiwenga, appeared in court yesterday.

Magistrate Dismisses Marry Mubaiwa’s Permanent Stay of Prosecution
Her appeal for a permanent stay of prosecution was dismissed by Harare Regional Magistrate Feresi Chakanyuka, who cited delays primarily caused by the defense.
According to The Herald, Marry Mubaiwa had argued that her deteriorating health and the prolonged proceedings made it unjust to continue with the trial.
Magistrate Chakanyuka, however, ruled against the application, stating,
“The permanent stay of prosecution is not the remedy to deal with the case. Rather, investigations shall be conducted for us to understand the reason for the delay.”
She emphasized that the repeated postponements, initiated by the defence, had prejudiced the complainant, who is eager to see the case concluded.
Defence Claims Unreasonable Delay
Represented by her lawyer, Beatrice Mtetwa, Marry Mubaiwa argued that the delays in the trial were excessive and affected her ability to receive a fair trial. The defence stated in its application,
“The applicant’s health has materially deteriorated to an extent that it would not be in the interests of justice to persist with the criminal prosecution.”
The State sought a postponement to review the defence’s application, further extending the timeline of the case.
