The National Prosecuting Authority (NPA) wants the case against Malusi Booi and nine of his co-accused added to a year-long criminal matter of alleged 28s gang boss Ralph Stanfield and 15 others.
Booi and nine others appeared in person at the Cape Town Magistrates Court while Stanfield and the rest of the accused, who are currently in custody, appeared via a video link from prison.
This means 26 accused appeared before the magistrates on Wednesday, facing 54 charges in total.
The prosecution told the court that it intended to add 24 more people to the indictment, taking the number of accused to 50.
It asked the court to postpone the matter to January to finalise its investigation and to join all the accused.
However, defence lawyers were having none of this, arguing that this was a premature joinder of cases and an injustice the court could not ignore.
They said cases against 14 of the accused currently in custody were finalized in August and should be transferred to a higher court.
The case continues.
