Zimbabwean Man Jailed for ‘Stealthing’ in Rare UK Conviction
In a groundbreaking verdict, Guy Mukendi, a 39-year-old Zimbabwean man residing in Brixton, has been sentenced to four years and three months in prison for the crime of “stealthing.”
Stealthing is the act of removing a condom during lula lula without the other person’s consent. This rare conviction was handed down by the Inner London Crown Court on Thursday.
Rare Conviction for Nonconsensual Condom Removal: Details of the Case
According to the Guardian, the incident hapoened last year when Mukendi had consensual lula lula with a woman under the condition that he would use a condom. However, he removed the condom without her knowledge or consent, leading to his r*pe conviction.
Metropolitan Police officers collaborated closely with the victim, securing critical evidence, including screenshots of messages in which Mukendi admitted to the act, apologizing and attributing his actions to not having had lula lula in a long time.
Despite his attempts to delete these messages, forensic evidence gathered by the police and the victim proved instrumental in the trial.
Police Statements and Investigation
DC Jack Earl, who spearheaded the investigation, emphasized the strength of the case built against Mukendi.
“Throughout this investigation, Mukendi denied any wrongdoing, but our officers built a compelling case against him to leave no doubt in the jury’s mind. We were dedicated to securing justice for the victim and will continue to raise awareness that this crime is a form of r*pe,” Earl stated.
Earl also praised the victim’s bravery for coming forward immediately.
“The victim did the right thing to call the police straight away and her bravery should not be overshadowed. If you have been a victim of s*xual violence and not yet reported it, please contact your local police service and we will do all that we can to help and bring you justice.”
Legal Context and Prevalence of Stealthing
Nonconsensual condom removal, or stealthing, is legally recognized as rape under the S*xual Offences Act 2003 in England and Wales.
According to this act, consent is valid only if given freely and with the capacity to make that choice, and deception regarding the nature or purpose of the act nullifies consent.
