Former Public Protector Advocate Busisiwe Mkhwebane is not giving up on her bid to review the decisions of the Section 194 inquiry that led to her removal from office. Mkhwebane is going to the Supreme Court of Appeal (SCA) on Wednesday to appeal the full bench judgment of the Western Cape High Court that dismissed her application with costs.
Mkhwebane has turned to the appeal court contending that she raised a number of crucial issues for determination by the court a quo, but the judges shied away from determining the merits of the case and only gave a ruling based on what she terms as a “superficial technical point.
The court, in its dismissal, found among other things, that it is only ‘in rare cases where grave injustice might occur, that a court will entertain an application for review before the conclusion of such proceedings.
