Kelvin Kagondo, a resident of Harare, has been ordered to remain in custody until July 22, 2024, following accusations of murder arising from an incident where he allegedly defended himself against attackers.
Kagondo’s case is proving complex. He was defending himself after a group of people attacked him. Harare magistrate Apollonia Marutya issued the directive, which recommended that Kagondo apply for bail through the High Court.
Details of the Incident
Prosecutor Thomas Chanakira outlined that on July 3, Kagondo was on his way back home in Retreat Waterfalls, Harare. He was transporting various items including children’s bicycles, a pram, a guitar, and a bucket of boiled eggs from his mother’s house located within the same area.
As he passed a local beer establishment, Kagondo was confronted by a group, including the deceased, who accused him of theft. They proceeded to assault him, demanding a confession regarding the origin of the items.

During the confrontation, Kagondo reportedly retaliated by throwing a quarter-brick at his aggressors. The brick struck one of the attackers on the head, causing him to fall unconscious. The injured individual was later declared dead at Sally Mugabe Central Hospital.
Kagondo fled the scene but was subsequently apprehended. The police discovered him wearing a shirt stained with blood, and during their investigation, they found the blood-stained brick allegedly used in the incident.

Kagondo’s case has drawn significant attention, with many waiting to see how the courts will handle the complex issues of self-defence and culpability. The magistrate’s advice to seek bail from the High Court suggests a potentially lengthy legal battle ahead.
