Justice Sunsley Zisengwe handed down the ruling after top Masvingo lawyer Rodney Saratoga Makausi sued the rapper over a March 2023 Instagram post. In the post, shared with Kikky’s 235,000 followers, she alleged that Makausi was attempting to pursue her romantically. Makausi, who is also a businessman, initially sought US$500,000 in damages when Kikky refused to delete the post.

The rapper’s case took a turn for the worse when she failed to comply with legal procedures. She did not file Pre-Trial Conference (PTC) issues as instructed by Justice Garainesu Mawadze, nor did she attend the PTC on October 1, 2024. These failures prompted Makausi to seek a default judgment.
Represented by Samuel Banda of Advocate’s Chambers in Harare, Makausi amended his claim to US$60,000, though the court ultimately awarded him US$18,000 in damages.

Lawyer’s Reputation Damaged
In his testimony, Makausi emphasized how the allegations harmed his professional and personal reputation.
“As a devout Christian, professional man, respected legal practitioner and officer of the court, in a fairly small city like Masvingo, my reputation and character are my currency. The respondent’s defamatory posts have however caused irreparable harm to that fama. The embarrassment and ridicule that I have suffered as a result of her defamatory post is borne for no reason at all. While it is not mathematically possible to fully compensate for the injury, I verily believe that an award of damages in the sum of US$60 000 would serve in some way to ameliorate the injury to my reputation,” said Makausi.
Earlier in the case, Kikky filed a plea to have the lawsuit dismissed, arguing that Makausi could not demand civil damages in US dollars since it is not Zimbabwe’s official currency. Justice Zisengwe dismissed her plea, allowing the case to proceed.
