Prosecutors say convicted murderer and rapist Luyanda Botha’s actions related to an attempted rape case ten years ago were enough to make the complainant believe he wanted to s.e.xually assault her.
Botha who is serving a life sentence for the rape and murder of 19-year-old Uyinene Mrwetyana in 2019 is currently on trial for the attempted rape of a student at Athlone Nursing College in 2014.
The complainant previously testified that Botha punched, choked, and kicked her after finding her in the shower at Athlone Nursing College.
State prosecutor Xolani Ncoba says Botha’s actions show he wanted to sexually assault the complainant.
“He grabs the complainant your worship. Her towel falls off. Has a scuffle with her and is on top of her. That in itself could be viewed as an attempt by the accused.”
Defence attorney Kyle Petersen denies Botha assaulted the complainant saying she invented the story to bolster her allegations.
Judgment is scheduled to be handed down on the eighth of November.
