A 78-year-old retired man has been ordered by the court to pay backdated maintenance for his children, despite them being adults now.
The pensioner has been mandated to settle longstanding child support payments for his now-adult children. Francis Nyandoro appeared before Magistrate Faina Makumbe seeking termination of a maintenance order, only to receive an opposite judgment.

Nyandoro argued before the civil court that his maintenance obligations should cease as both children had reached legal adulthood, with one currently employed.
“My children are now over 18 years old, and one has secured employment. I request the court to relieve me of this order,” he stated.

The respondent, Zvisinei Diringa, challenged Nyandoro’s application, revealing he had discontinued payments before the children came of age.
“He abandoned his financial responsibilities prematurely, leaving school fees unpaid. This debt prevented my son from collecting his A-level certificate,” Diringa explained to the court.
She petitioned the magistrate to enforce payment of both the delinquent school fees and accumulated maintenance arrears.
Courts Reject Financial Hardship Defense
The pensioner attributed his non-compliance to retirement-induced financial instability. He shared with the courts that he left his job, and he did not have a fixed income, which made him miss some of the maintenance payments.
“After leaving employment, my income became unpredictable, making consistent payments impossible,” Nyandoro defended.

Magistrate Makumbe ruled that while maintenance orders typically expire when children reach majority, outstanding balances remain enforceable.

“You must clear all arrears to avoid legal consequences,” she pronounced.
