Joburg City’s Floyd Brink heads to court to halt looming arrest

Johannesburg city manager Floyd Brink is heading to court on Tuesday to halt his looming arrest, pending the outcome of an application to cancel the warrant.

Brink was issued with the warrant last week, which was issued after he was allegedly found in contempt of a court order interdicting the city from cutting off the water supply to an electrical imports business.

The warrant was not effected due to a spelling mistake in Brink’s name.

In the papers, Brink argues the contempt application wasn’t served on him personally and that he wasn’t even aware it was in court.

He argued that the warrant issued was, in fact, suspended for a year.

But the company, Pibir Investments, maintains that Brink was aware of these proceedings as far back as 17 August when they wrote to his attorneys.

Pibir argued that when the matter was before the court, their position was that suspending the warrant would only “kick the ball further down the road”, and the judge was with them and personally signed and agreed to its issuance.

The company has also launched a counterapplication to verify the order that was handed down to correct the spelling of Brink’s name and to uplift the suspension of the warrant.
