Julius Malema accuses EC High Court Judge candidate of being complacent in his preparation

A candidate for the High Court Judge position in the Eastern Cape has been accused of coming across as complacent in his preparation for his interview before the Judicial Service Commission (JSC).

Advocate Pretorius Msiwa is the last candidate to field tough questions in Tuesday’s round of interviews.

The commission has interviewed candidates for the Land Court, the Labour and Labour Appeals Court and the Eastern Cape High Court.

Msiwa is up against Magistrate Irfaan Khalil for the post in the Eastern Cape.

During his interview, Commissioner Julius Malema accused Msiwa of a lack of preparation.

“You don’t remember your judgements, you don’t know how judgements get reported, you don’t remember even when given the opportunity now. You still struggle to tell us which judgements were you leading.”

Malema has also grilled Msiwa on his declaration that he is a member of the African National Congress (ANC).

Earlier, Msiwa told the JSC that he was only made aware on Tuesday by the Chief Justice Mandisa Maya that an aspirant judge cannot be a member of any party.

“You are not just an ordinary person senior council. I am going to argue that you are not suitable to be a Judge,” said Malema.

Msiwa: “Honourable Malema you will be unfair to leave with that impression – I am not complacent. I come here to apply for consideration but everyone is entitled to make his observation about me.”
