Journalist Edmund Kudzayi has strongly rejected a High Court ruling that awarded Advocate Fadzayi Mahere US$100,000 in a defamation case, accusing her of lying under oath and alleging misconduct by the presiding judge.
In a post on X, Kudzayi called the judgment in Mahere v Kudzayi a “procedural sham,” claiming it was based on false information supplied by Mahere and facilitated by what he sees as negligence—or worse—on the part of Justice Wamambo.
Kudzayi Claims Mahere Lied to the Court
According to Kudzayi, Mahere falsely claimed in her court application that she had applied for a pre-trial conference, when in fact, the case had previously been struck off the roll due to inactivity.
He argued that there is no evidence on record to support her claim—no application, and none of the required Rule 49 documents. Based on that, Kudzayi says Mahere committed perjury to resurrect a case the court had already dismissed twice.
“Mahere’s misrepresentation revived litigation the Court had twice struck off, leaving the ensuing default judgment a procedural shell built on perjury.”
The legal dispute stems from a 2022 article published on Kudzayi’s platform Kukurigo, which alleged that Mahere had an affair with businessman Tinashe Murapata. Mahere denied the claims, arguing they were false, defamatory, and a violation of her privacy.
After Kudzayi failed to attend court proceedings, the High Court granted Mahere US$100,000 in damages in a default judgment.
Kudzayi says he wrote to Justice Wamambo in March 2025 to warn the court that the proceedings were based on fraudulent information. According to him, the judge’s office signed for the letter, but later claimed not to have seen or read it.
“What sort of judge signs for a document and then professes ignorance of its contents? A shameless judge without honour.”
Kudzayi also accused Mahere of skipping a required round-table meeting, a step meant to clarify trial issues before the case proceeds. He believes this allowed Mahere to avoid scrutiny and helped push the case forward without a proper process.
He now plans to file an urgent court application for rescission, citing the legal principle fraus omnia vitiat—Latin for “fraud vitiates everything.”
