The prosecution has slammed the alleged underworld gang boss, Nafiz Modack, for allegedly trying to mislead the court on Monday with fabricated evidence.
Modack and his 14 co-accused were back in the dock on Monday to account for the 122 charges they face related to various crimes, including the murder of top cop Charl Kinnear.
Defence attorney Bashier Sibda told the court Modack hired co-accused Zane Kilian to “investigate” whether Kinnear was colluding with alleged underworld gang boss Jerome “Donkie” Booysen.
Sibda said Modack wanted to prove the pair had a corrupt relationship and presented the court with a list of pings that showed Booysen and Kinnear were at one particular location in Belhar for a period of time.
However, Hawks Edward du Plessis refuted the list, saying the Hawks’ evidence shows Booysen was at the location but not Kinnear.
After examining the list presented by Sibda the State said the list was ” a total misrepresentation of evidence” which was manipulated in an attempt to mislead the court.
Sibda denied tampering with the list, saying he received it in a bundle of evidence documents from Modack.
Judge Henney accepted Sibda’s response and warned that the State could consider taking further action at a later stage.
The trial continues.
