The man convicted of the rape and murder of 19-year-old University of Cape Town (UCT) student Uyinene Mrwetyana in 2019 has failed to have an old attempted rape case struck from the court roll on Tuesday.
Luyanda Botha, who is currently serving a life sentence, appeared in Wynberg Magistrates Court on Tuesday, where he is on trial for the attempted rape of a 21-year-old nursing student in 2014.
Botha, who alleges he went to visit his girlfriend at Athlone Nursing College on the day of the alleged incident, made an application to have the case struck from the roll.
Prosecutors said Botha found the victim taking a bath and attempted to rape her, but she fought him off.
The victim then laid a complaint, but after attending initial court proceedings, she disappeared and the matter was then removed from the roll.
After Botha was arrested for the rape and murder of Mrwetyana in 2019, the victim then reopened the attempted rape case.
The court has now denied Botha’s attempt to have the charges against him withdrawn, saying there’s enough evidence for the matter to proceed.
