Unlicensed Kombi Driver Faces Court After Running Over Pedestrian

An unlicensed kombi driver is facing charges in court after he ran over a pedestrian and blamed it on oncoming traffic.

A 29-year-old commuter omnibus operator stood before magistrates this week facing charges related to a March traffic incident that left a pedestrian with severe injuries.

The man, based in Bulawayo, was driving a kombi despite not having a license.

Derek Mloyi, residing in Nkulumane, appeared before Western Commonage magistrate Archie Wochiwunga to answer allegations of reckless driving. The court granted him bail with instructions to return on July 23 for further proceedings.

Prosecutor Audrey Kufandikanwe presented the state’s case, outlining that the collision occurred on March 27 at approximately 7:40 PM along Khami Road. Mloyi, operating a Toyota Hiace without proper licensing credentials, allegedly struck pedestrian Dumisani Ncube who was walking along the roadway.

“The victim sustained significant injuries requiring immediate hospitalization at Mpilo Central Hospital,” stated Kufandikanwe during proceedings.

Prosecution’s Argument And Defence’s Position

Legal representatives for the state asserted that Mloyi demonstrated negligence through excessive speed and failure to maintain proper road awareness. These alleged violations of traffic safety protocols resulted in the serious accident.

The accused offered a different account, maintaining the incident resulted from evasive manoeuvres rather than intentional action. Mloyi testified that he swerved to avoid opposing traffic when contact occurred with Ncube within his lane of travel.

Legal Implications

This case highlights growing concerns about unlicensed commercial drivers and pedestrian safety in urban areas. Legal experts note that convictions for similar offences often result in license suspensions, fines, or imprisonment, depending on injury severity.

The judicial process continues later this month as both sides prepare additional evidence regarding the traffic violation and subsequent injuries.
