Police Acted On Tip-Off

The court heard that on 31 July 2026 at around 5pm, police received information alleging that Phiri was carrying dagga while at Somvubu High School.

Officers responded to the report and searched the teenager, allegedly recovering a small sachet containing what was suspected to be a half-smoked roll of dagga.

The substance was later taken to the Turk Mine Post Office, where it was weighed in the presence of both the accused and police officers.

According to a weighing certificate produced in court, the suspected dagga weighed just 0.005 grams.

Guilty Plea Leads To Conviction

State papers alleged that Phiri unlawfully and intentionally possessed the dangerous drug despite not being registered or authorised to have it.

After pleading guilty to the charge, he was convicted by the court.

Fine Or Six Months In Prison

Magistrate Mahembe sentenced Phiri to pay a US$300 fine by 5 September 2026.

If he fails to pay the fine by the deadline, he will serve six months in prison.

The court also imposed an additional six-month prison sentence, wholly suspended for five years. The suspended sentence is conditional on Phiri not committing another offence involving the unlawful possession, use, manufacture or dealing in dangerous drugs during that period.
