Elderly Harare Mother Wins Court Case Against Three Abusive Sons In Property Battle

A 79-year-old Harare mother has been granted a lifeline by the courts after enduring what she described as a living nightmare at the hands of her own three sons. Faina Bhera sought and won a protection order against her married sons, who have now been legally compelled to vacate the family home and cease their alleged harassment.

The Harare Civil Court heard a poignant account of a mother’s suffering, as Mrs Bhera detailed the relentless abuse and disruption that had become her daily reality.

The core of the dispute centred on the refusal of Mrs Bhera’s sons, Edson, Simon, and Morris Mususwa, to leave the family residence at 510 Magandanga Road. Despite all being married and having families of their own, with one son having five children, another four, and the third one child, they remained under their mother’s roof. Their presence, however, was far from supportive. Mrs Bhera explained how their behaviour had shattered her peace.

She told the magistrate, “They come back drunk and cause disturbances,” a pattern of behaviour that left her feeling profoundly isolated and neglected in her own home. The situation had become so intolerable that the pensioner was forced to turn to the legal system for protection from her own children.

The conflict extended beyond mere emotional distress, severely impacting Mrs Bhera’s financial security. The elderly woman revealed her plans to generate a much-needed income by renting out a portion of her property, a practical solution to her economic struggles. This plan, however, was fiercely resisted by her sons, leaving her in a precarious position.

With visible emotion, Mrs Bhera shared her desperation with the court, stating,

“I want to accommodate tenants so I can put food on the table.”

This simple aspiration highlighted the profound control her sons wielded over her life, blocking her path to self-sufficiency and compounding her sense of powerlessness.

After considering the heartfelt testimony, the presiding magistrate delivered a ruling that firmly sided with the elderly mother. The court issued a definitive protection order, severing the sons’ access to the property and their mother’s legal rights.

The magistrate explicitly ordered,

“Your three children, Edson, Simon, and Morris, must stay away from your house at 510 Magandanga Road in Mufakose and must not harass you.”

The decision grants Faina Bhera the peace and security she so desperately sought, finally allowing her to live without fear within the walls of her own home.
