High Court Quashes Musa Manyika’s 15-Year Rape Sentence Over Trial Defects

The High Court has quashed the conviction and 15-year prison sentence imposed on former Old Mutual manager Musa Nyasha Dube Manyika.

Manyika, 43, was convicted in March on two counts of rape. He subsequently received an effective 15-year prison sentence.

However, the High Court has now found serious defects in the record of his trial.

High Court finds serious trial discrepancies

The case involved allegations of two separate rapes involving a University of Zimbabwe student.

The first alleged rape occurred in 2022, while the second allegedly happened in 2024.

During its review, the High Court identified material and irreconcilable discrepancies within the trial record.

Those discrepancies raised serious concerns about the proceedings conducted in the magistrates court.

As a result, the High Court exercised its review powers to intervene.

The court subsequently set aside the magistrates court proceedings and overturned Manyika’s conviction.

Manyika ordered to walk free

Following the ruling, the High Court ordered Manyika’s immediate release from custody.

The decision effectively nullified the conviction and sentence previously imposed against him.

Manyika had faced a lengthy prison term after being found guilty in March.

However, the High Court’s review focused on defects within the trial record.

The court determined that those defects were serious enough to invalidate the proceedings.

The ruling therefore brings a major development in the case involving the former Old Mutual manager.

The allegations concerned events separated by two years, making the case closely watched.

For now, Manyika’s conviction and effective 15-year sentence have been set aside following the High Court review.

The ruling highlights the importance of accurate and internally consistent trial records during criminal proceedings.
