Illegal Chinese Miner Jailed 5 Years For Shooting Zimbabwean Gold Panner

BULAWAYO – A Chinese mining supervisor who was in Zimbabwe illegally has walked away with an effective five-year jail term after shooting a 31-year-old Zimbabwean gold panner dead in Gwanda, sparking outrage over how foreign nationals with immigration warrants are allowed to operate mines with firearms.

The fatal incident happened on 5 March 2025 at Long Fortune Mine in Collen Bawn. Sentence was handed down at the Bulawayo High Court, nearly one year to the day after Pardon Gumbo lost his life.

Judge Calls Shooting “Completely Reckless”

Zimlive reports that Yang Zhian, 37, was convicted of culpable homicide after the court ruled that he acted with a high degree of negligence when he opened fire on a group of artisanal miners. He was acquitted of murder.

Justice Chivhayo sentenced him to eight years in prison but suspended three years on condition of good behaviour. That leaves him with an effective five-year sentence.

In passing sentence, the judge said:

“The deceased lost his life in broad daylight. He was looking for gold. The use of a firearm in those circumstances was completely reckless.”

The court heard that Gumbo was shot in the forehead and later pronounced dead at Gwanda Provincial Hospital. He and other miners had entered the mine armed with metal detectors and a mattock.

Security guard Gift Tashinga Mandeya tried stopping them near a slime dam, then alerted Zhian. Witnesses testified that between seven and eight shots were fired. Zhian claimed he had only fired three warning shots in self-defence.

The judge outlined what he described as the “golden rules about guns”:

“If in doubt, do not fire. Where force is unavoidable, the aim should be to disable rather than to kill.”

Immigration Warrant Revealed

The defence told the court that Zhian had spent a year in remand prison, even after the Supreme Court granted him bail, due to an outstanding immigration warrant of detention. His illegal immigration status was raised during mitigation.

The court did not disclose his original immigration status, only that authorities had issued a warrant for his detention separate from the murder case.

This means a foreign national wanted by immigration officials was employed as a mine supervisor with access to firearms. He shot and killed a Zimbabwean citizen while immigration authorities already had reason to lock him up.

Family Rejects Blood Money

Defence lawyer Admire Rubaya told the court Zhian had paid US$4,000 (approximately R76,000) towards funeral expenses and was prepared to offer US$5,000 (about R95,000) for the medical care of Gumbo’s widow and their two-year-old son.

But the victim’s father dismissed the claims in an emotional address:

“The death of my child is not worth any payment.”

He added:

“When I needed assistance, I didn’t get it.”

The father said he had gone to the mine seeking blood-stained soil to bury with his son, but was allegedly told that the company did not assist “people who were stealing.”

When asked what compensation he would accept, he replied:

“I’m emotionally unstable to make a rightful decision.”

The State had pushed for a 15-year jail term, arguing that a strong message needed to be sent, particularly in cases involving foreign nationals and firearms. Prosecutors told the court the shooting happened during the day and the prospectors were unarmed.

30 Years For Another

While Zhian walked with five years, the Supreme Court recently took a harder line with another Chinese miner.

On 3 February 2026, the court dismissed an appeal by Cai Yulong, a Chinese mine operator in Zhombe who shot dead worker Goni Goni on 24 May 2024. Cai claimed self-defence against illegal panners.

Justices Joseph Musakwa, Susan Mavangira and Chinembiri Bhunu threw out his appeal. Cai will serve 30 years.

“The appellant armed himself, confronted the alleged intruders and fired at fleeing individuals,” Justice Musakwa wrote. “He subjectively foresaw the possibility of death and reconciled himself to it.”

The court noted Goni was shot from the side of the thigh – suggesting he was running away. The trajectory undermined his self-defence claim.

The difference? Thirty years versus five years. A fleeing worker versus a forehead shot in broad daylight.
