Knife Supplier Jailed For 20 Years After Teenager Killed In Bar Music Dispute
A Zimbabwean man who supplied a knife during a fight over music at a bar has been sentenced to 20 years in prison for his role in the murder of an 18-year-old patron. The High Court ruled that Timothy Mathonsi shared criminal responsibility for the killing, even though he did not personally stab the teenager.
The case stems from a confrontation at Gombe Bar in Wozoli Business Centre, Silobela, on 16 August 2018. In his sentencing judgment, Justice Munamato Mutevedzi said the teenager’s life was lost over a seemingly minor disagreement.
How A Music Dispute At A Silobela Bar Turned Deadly
The court heard that Mathonsi handed a hunting knife to Handsome Ngwenya after an initial confrontation with Simon Dube appeared to have subsided.
Ngwenya then attacked Dube as he walked back towards the bar, stabbing him twice in the chest and once at the back of the head. Dube was taken to Kwekwe District Hospital, where he was pronounced dead on arrival.
Justice Mutevedzi said:
“The deceased was a youthful person aged only 18 years. His life was abruptly and senselessly extinguished over what began as a trivial misunderstanding relating to music being played in a bar.”
Mathonsi denied supplying the knife. However, the judge rejected his explanation after two witnesses independently testified that they had seen him hand the weapon to Ngwenya shortly before the fatal attack.
Why The High Court Sentenced Mathonsi To 20 Years
The judge found that Mathonsi was liable as a co-perpetrator because he supplied the weapon during the confrontation and fled with Ngwenya after the stabbing. The court also heard that he encouraged Ngwenya to escape rather than help Dube or report the incident.
Justice Mutevedzi said:
“An individual who supplies a lethal weapon during an ongoing assault must be treated with equal moral and legal blameworthiness as the person who ultimately inflicts the fatal blow.”
The National Prosecuting Authority sought a 20-year sentence, while Mathonsi’s lawyer requested 10 years, citing his age, first-offender status and the fact that he had not inflicted the fatal wounds himself.
The judge ruled that life imprisonment would be disproportionate but that 20 years was appropriate given the aggravating circumstances. He also warned about knife violence, particularly among young men settling minor disputes.
“Mercy should not be confused with undue sympathy,” Mutevedzi said.
Mathonsi was consequently sentenced to 20 years’ imprisonment. The ruling underscores the legal consequences of supplying a deadly weapon during a violent confrontation, even when another person carries out the fatal attack.
