Former Shop Manager Jailed for Stealing US$2,230 Meant for Vehicle Purchase
A Bulawayo court has sentenced a former retail shop manager to an effective five months behind bars after he was found guilty of misappropriating money that had been entrusted to him for the purchase of a vehicle.
Enias Phili (55) was convicted of theft after a trial before Bulawayo Magistrate Challenge Mahembe. Despite maintaining his innocence throughout the proceedings, the court ruled that the prosecution had presented sufficient evidence to prove the charge.

Court Orders Restitution
According to The Chronicle, Magistrate Mahembe imposed a 24-month prison sentence on Phili. However, four months were suspended on condition that he does not commit a similar offence within the next five years.
A further 15 months were conditionally suspended pending repayment of US$2,230 to the complainant. As a result, Phili will serve an effective five-month jail term.
In his ruling, the magistrate rejected the accused’s version of events, saying the evidence presented by State witnesses clearly demonstrated that the money had been unlawfully converted for personal use.
Vehicle Deal That Never Materialised
The court heard that on February 2 this year, the complainant handed over US$2,200 to Phili in Bulawayo as a deposit towards the purchase of a Toyota Hilux valued at US$7,000.
The following day, the complainant transferred an additional US$30 via EcoCash, bringing the total amount entrusted to Phili to US$2,230.
Weeks later, with no progress on the vehicle transaction, the complainant began making inquiries and discovered that the deal had not been processed as expected.
Attempts to contact Phili reportedly proved fruitless, with his phone becoming unreachable.
Abuse of Trust
During sentencing submissions, prosecutor Brenda Ndlovu argued that the offence was aggravated by the fact that the complainant had placed considerable trust in the accused.
She told the court that the complainant repeatedly tried to recover his money after realising he had been misled but was ignored.
The prosecution further submitted that the complainant suffered a significant financial loss while the offender personally benefited from the crime, urging the court to impose a custodial sentence as a deterrent to others.
Following a police report, investigations led to Phili’s arrest and subsequent prosecution. The court ultimately found that he had failed to use the funds for the intended vehicle purchase and had instead diverted the money for his own benefit.
