Zimbabwe Moves To Establish Sex Offenders Register As Government Weighs Privacy Concerns
Zimbabwe is moving to establish a sex offenders register as the Government steps up efforts to curb sexual offences. However, officials say privacy, human dignity and constitutional rights are among the major issues that must be carefully considered before the proposed system takes shape.
It comes as authorities seek measures aimed at protecting women, children and other vulnerable groups from sexual violations.
Zimbabwe Sex Offenders Register Consultations Begin
The Herald reports that the Ministry of Justice, Legal and Parliamentary Affairs, through the Department of Law Development, held a stakeholder consultation workshop on the proposed register.
Lawyers, women’s organisations, civil society groups and representatives from several Government departments took part in the discussions.
Justice, Legal and Parliamentary Affairs Permanent Secretary Vimbai Nyambai Nyemba said the proposal raised important questions.
Nyemba said:
“Any proposal to establish a sex offenders register raises significant legal and policy considerations.”
She said authorities would have to examine several factors before settling on a legal framework.
“It requires careful examination of issues relating to privacy, human dignity, rehabilitation, reintegration, data protection, institutional capacity and, ultimately, whether such a system would effectively contribute to preventing sexual offending and protecting vulnerable members of society.”
Government Weighs Privacy And Public Protection
Nyemba said the process must balance the protection of vulnerable people with constitutional rights.
She explained:
“Our task is therefore to strike the appropriate balance between protecting the public and preserving the constitutional rights that define our democratic legal order.”
The Permanent Secretary added that any measures adopted would need to be proportionate and effective.
“Justice demands both accountability and fairness. It requires us to protect those who are vulnerable while ensuring that every legal measure we adopt is proportionate, necessary and effective.”
No Predetermined Outcome On Sex Offenders Register
Nyemba stressed that the consultation was not being held to approve an already settled position.
She said:
“We are not gathered to endorse a predetermined outcome. We are here to examine the evidence. We are here to learn from comparative experience.”
She added:
“And we are here to determine which legal framework best serves Zimbabwe’s interests.”
The consultations place the proposed sex offenders register firmly under discussion. The final legal framework and how the system could operate will depend on the outcome of the ongoing process.
