Mai Jeremaya Rape Case: Prosecutors Explain Why They Support Release of Accused
Prosecutors have revealed why they are not opposed to the release of the duo accused of raping Mai Jeremaya.
Thabo Blessing Dube 27, and Martin Charlie, 25, were arrested over the weekend and appeared in court on Monday 5 May charged with raping socialite Mai Jeremaya.
The pair, who were arrested over the weekend and appeared in court on Monday, 5 May, are facing rape charges. However, when they applied for bail, the magistrate questioned why the State wasn’t objecting and demanded a formal explanation.
Mai Jeremaya Rape Case: State Explains Why They Support Release of Accused
On Tuesday, 6 May, the State filed its reasons ahead of Magistrate Marewanazvo Gofa’s ruling, also summarising the defence the accused gave during vetting. The two men denied the rape allegations.
In its court documents, the State said there was no strong reason to keep Dube and Charlie in custody while they await trial. It argued that nothing about the case suggests they pose a flight risk or would interfere with the proceedings.
“It is the State’s view that such forceful and convincing reasons, which will make the court feel very strongly that the accused should not be released on bail, do not exist,” part of the submissions read.
Accused Not Seen as Flight Risks
The State also pointed out that both men have permanent homes and stable addresses, making it unlikely they would run away.
“The State does not have any well-founded fears that if released on bail, the two will abscond and not attend their trial, as they are of fixed abode, shown by their residential addresses on the face of the Request for Remand form,” the submissions further read.

No Criminal Records or Pending Cases
It added that neither Dube nor Charlie has a criminal record or any other cases pending in court. As a precaution, the State recommended that they surrender their passports if granted bail.
“They do not have any known previous convictions or pending cases before the criminal courts, and they did not exhibit any conduct from which any inclination to abscond can be inferred. The State is satisfied that the accused persons are sufficiently tied to the jurisdiction of the court and may be ordered to surrender their passports,” the State said.
