Mike Chimombe Applies For Case Discharge in High Court Over Goat Tender Controversy

Prominent ZANU PF committee member and entrepreneur Mike Chimombe, alongside business associate Moses Mpofu, have formally requested a case discharge in their high-profile $7 million fraud case related to an unsuccessful government livestock supply agreement.

The defendants’ legal team, led by attorneys Tapson Dzvetero and Ashiel Mugiya, contends that prosecutors failed to establish sufficient evidence connecting Chimombe directly to the alleged misrepresentations in the agricultural ministry tender process.

According to court documents, the pair allegedly falsely presented Blackdeck Livestock and Poultry Farming as a properly registered entity with valid tax compliance certificates. The company reportedly delivered only 4,208 goats out of a contracted 85,691 after receiving ZWL$1.6 billion (approximately $7.7 million USD), leaving a $7.4 million shortfall.

Key Defense Arguments

The lawyers cited that no direct evidence linking Chimombe to bid document preparation and expressed the unclear capacity in which Chimombe attended ministry meetings.

Missing official minutes from alleged meetings were raised as a concern and there was no demonstrated relationship between Chimombe and Blackdeck.

“The prosecution hasn’t shown whether any misrepresentation occurred verbally or in writing,” Dzvetero argued. “Without prima facie evidence of wrongdoing, our client shouldn’t be compelled to mount a defense.”

Business Relationships Under Scrutiny

The defence emphasised that Chimombe participated in the tender process through his company, Millytake Enterprises, which ultimately lost the bid. Legal representatives stressed that Blackdeck’s official documents don’t identify Chimombe in any capacity – as director, shareholder, or employee.

“Even if Mr. Chimombe maintained friendship with Mr. Mpofu, that doesn’t establish legal responsibility for Blackdeck’s operations,” the defense team submitted. “We maintain our client has no case to answer and request full discharge with a not guilty verdict.”

The case continues to draw significant attention as it intersects business, politics, and agricultural procurement processes in Zimbabwe. Legal analysts suggest the discharge application could prove pivotal in determining whether the matter proceeds to full trial.
