High Court Orders Seizure Of 17 Vehicles From Multiple People In Civil Servants Rebate Abuse

The High Court has ordered the seizure of 17 vehicles taken from multiple people after finding that the civil servants’ vehicle rebate scheme was abused through forged documents, in a case prosecutors say was masterminded by a former Zimbabwe Revenue Authority (ZIMRA) officer. The ruling follows a civil forfeiture application brought by the State, after the court found that the vehicles were imported without payment of customs duty using fraudulent rebate letters.

The judgment arises from proceedings involving former ZIMRA employee Tambudzai Yvonne Musoni and 33 others, under case number HCHACC137/24. The court ruled that the vehicles were tainted property and should be forfeited to the State.

Abuse Ran Between 2022 And 2023

In a statement issued on 29 January 2026, the National Prosecuting Authority of Zimbabwe confirmed that the abuse occurred over a 14-month period.

“The court found that Tambudzai Yvonne Musoni, formerly employed at ZIMRA Harare Port, abused the Civil Servants Vehicle Import Scheme between January 2022 and March 2023,” the authority said.

“She fabricated and confirmed fraudulent duty rebate letters which were unlawfully issued to non-civil servants and rejected applicants.”

The authority said the forged letters were used to clear vehicles without paying customs duty.

“These letters enabled the clearance of vehicles without payment of customs duty at major ports of entry,” the statement read.

Musoni resigned from ZIMRA in April 2023 while investigations were underway. Prosecutors say she later left the country. Her current location could not be independently confirmed [I cannot verify this].

Vehicles And Cash Forfeited

The High Court ordered that 17 vehicles imported using the forged rebate letters be forfeited to the State. The ruling also covered cash held in school trust accounts.

“The court declared several assets tainted and ordered their forfeiture, including US$37,201 (about R706,819) in school trust accounts and 17 motor vehicles,” the National Prosecuting Authority said.

The authority clarified that some assets were released.

“Some properties and vehicles were released where owners proved legitimate purchase prior to or outside the fraud.”

Earlier court proceedings had resulted in freezing orders to prevent the disposal of suspected proceeds of crime while investigations continued.

Prosecutors Welcome Judgment

The National Prosecuting Authority said the ruling reinforces accountability.

“This ruling reinforces the principle that crime does not pay,” the authority said.

“Proceeds of corruption and abuse of office will be traced, recovered, and forfeited to the State.”

The authority added that it remains focused on protecting public resources.

“The Authority remains committed to safeguarding public resources and combating economic crimes in the interests of justice and accountability.”
