Concourt sets date for 2030 term extension hearing

The Constitutional Court will hear a challenge to Zanu PF’s Resolution 1 of 2024 on February 9, 2026. The resolution aims to extend President Mnangagwa’s tenure to 2030. This case now places constitutional interpretation under national scrutiny.

A civic group stands firm against what it sees as an attempt to bypass term limits. Meanwhile, the Government prepares to defend the legality of the resolution.

Civic Group Challenges Proposed Constitutional Changes

Ibhetshu LikaZulu and its secretary-general, Mbuso Fuzwayo, filed the application. They seek to block amendments to Sections 95(2)(b) and 143(1) of the Constitution. The applicants argue that these changes require a national referendum under Section 328(7).

They claim Zanu PF’s resolution weakens public participation and constitutional safeguards. However, the Government and Zanu PF call the case premature and speculative. They argue no formal amendment process has started yet.

The dispute focuses on how Section 328 of the Constitution should be interpreted. Zanu PF argues the proposal fits within Section 328(5), which allows certain amendments. The party says this approach avoids the fixed-term provisions in Section 328(7).

Officials maintain that their actions remain lawful, procedural, and necessary for stability. Cde Munyaradzi Machacha insists the process will include public hearings and legislative scrutiny. The party believes the amendment process will follow constitutional procedures if pursued.
