South African Driver Fined US$400 and Banned From Driving in Zimbabwe After Cyclist’s Death
A South African truck driver has been convicted of culpable homicide after he struck and killed a cyclist in Bulawayo earlier this year.
Mmantlebeka Ernest Modiba, of Polokwane, South Africa, appeared before Western Commonage magistrate Jeconia Prince Ncube, where he pleaded guilty to the charge.
How the Accident Occurred
Prosecutor Cathrine Kuzu told the court that the accident occurred on February 5 at about 4:15 PM.
Modiba was driving a Man Afrifit truck, registration number LJX873MP, towing two trailers, MF35CLGP and MF35HVGP, along Mpopoma Drive heading south.
The court heard that as he turned west into Khami Road near Woodlot Timbers (Pvt) Ltd in Kelvin, he collided with a cyclist, Hebert Nyasha Matukutuku, who was travelling east along Khami Road.
Matukutuku died on the spot due to injuries sustained in the accident.
The accused’s vehicle was later inspected at the Vehicle Inspection Department (VED) Bulawayo Depot as part of investigations.
Sentence and Driving Ban
Following his guilty plea, Modiba was sentenced to pay a fine of US$400. In default of payment, he will serve 12 months in prison.
The fine must be paid before March 3, 2026.
He was also banned from driving in Zimbabwe for 24 months.
