Legal Expert Says Defence Strategy Key in Chatunga Mugabe Case Outcome
A South African legal analyst has weighed in on the outcome of the shooting case involving Bellarmine Chatunga Mugabe, saying the defence team played a decisive role in limiting the severity of the sentences.
Mugabe and his co-accused, Tobias Tamirepi Mugabe Matonhodze, were arrested earlier this year after a shooting incident at a private residence in Hyde Park, Johannesburg, where a gardener, Sipho Mahlangu, was injured.

Different Outcomes for the Accused
The case concluded with contrasting outcomes for the two men.
Mugabe avoided imprisonment after pleading guilty to firearm and immigration-related offences. The court imposed a financial penalty of R600,000, with a jail term as an alternative should he fail to pay. He has since been deported back to Zimbabwe.
In contrast, Matonhodze received an effective three-year prison sentence after admitting to attempted murder and other related offences. His various sentences will run at the same time, reducing his overall time behind bars.
Plea Deal Seen as Turning Point
Commenting on the case, legal expert Melusi Xulu told SABC News that the defence adopted a calculated approach that shaped the final outcome.
“My view is, firstly, when you are faced with the crime, you will not give everything out to the state. You’ll kind of protect yourself,” he said.
Xulu suggested that withholding certain details may have prevented the prosecution from building a stronger case, particularly in relation to the firearm allegedly involved.
Lighter Sentence Than Expected
He added that some of the charges faced by the accused could have attracted far harsher penalties, especially those linked to illegal firearm possession, which can carry lengthy prison terms.
“I believe the plea deal played a role in terms of making sure that whatever issues, like a firearm that is not found, are addressed.
“At least they’ve got control of how they could drive a narrative and the sentence for the accused,” Xulu explained
Defence Team Praised for Strategy
Xulu credited the defence lawyers, including Sinenhlanhla Mnguni, for steering the matter toward a quicker resolution while minimising risk for their clients.
“So I think the legal team played a very good role in making sure that this matter is finalised faster on their own terms.
“Unfortunately for Tobias, he has to be inside, but it’s also less than what he could have got in another case, if it were another person,” he said.
