He Killed Her, Buried Her In The Yard – Then Blamed Provocation
A Harare man has been convicted for the death of his lover after the High Court found him guilty of culpable homicide and sentenced him to an effective 10 years in prison following a violent incident that ended in tragedy.
Herbert Pasipanodya was convicted of the death of his partner, Dorothy De Souza, whose body was later discovered buried in a shallow grave at his residence in July 2025.
Authorities said the case initially started as a murder investigation but later changed after the court considered the circumstances surrounding the incident.
Body Found Buried At Residence
The National Prosecuting Authority of Zimbabwe (NPAZ) revealed that the deceased’s body was discovered months after her death in July 2025.
Introducing the findings, the prosecution outlined what happened:
“In July 2025, the deceased’s body was discovered in a shallow grave at the offender’s residence. The offender was initially charged with murder. However, the court found that he acted under serious provocation after discovering the now-deceased engaged in a sexual act with an unidentified man.”
The court heard that the couple had lived together for more than a year. Their relationship, however, was reportedly marked by recurring violence.
According to the prosecution, events escalated on the night in question when Pasipanodya allegedly assaulted De Souza.
“On the night in question, the offender assaulted the deceased, inflicting injuries which resulted in her death.”
Medical experts later confirmed the cause of death.
“Medical evidence confirmed that the cause of death was multiple rib fractures sustained from blunt force trauma.”
Court Notes Attempt To Conceal Crime
The High Court also highlighted actions taken after the incident, which were considered aggravating factors.
Prosecutors told the court:
“The offender proceeded to bury the deceased’s body in a shallow grave within his yard and misled witnesses regarding her whereabouts, in a clear attempt to conceal the crime.”
These actions played a significant role in sentencing.
The court imposed an effective 10-year prison sentence for culpable homicide. A previously suspended three-month sentence, related to an offence against the same victim, was also activated.
Court Accepts Provocation But Warns Against Violence
While the court accepted provocation as a mitigating factor, it emphasised the seriousness of the offence.
The court stressed:
“While the court accepted provocation as a mitigating factor, it emphasized that unlawful violence resulting in loss of life remains a serious offence, particularly where efforts are made to defeat the course of justice.”
