Julius Malema Sentenced To Five Years In Jail For Firearm Offences

South African opposition leader Julius Malema has been sentenced to five years in jail for firearm offences after an East London court found him guilty of unlawfully discharging a rifle during a political celebration.

The ruling, delivered on 16 April 2026 at the East London Magistrate’s Court, follows Malema’s October 2025 conviction linked to a 2018 incident at the Economic Freedom Fighters (EFF) anniversary event in Mdantsane.

Court Rejects “Celebratory Shot” Defence

Magistrate Twanet Olivier made it clear that the court was not persuaded by arguments that the firearm was discharged in celebration.

Introducing her ruling, she stated:

“The sentence imposed should fit the offender as well as the crime. It must be fair to society and blended with a measure of mercy according to the circumstances of each matter.”

She dismissed the defence’s justification in strong terms:

“It is nonsensical to sugar-coat the discharge of a firearm as a celebratory act when it constitutes criminal conduct.”

The court emphasised that the act was not spontaneous. Instead, it was described as deliberate and organised.

“It wasn’t an impulsive act. It wasn’t anger. It was the event of the evening. It required planning as to how, when, and where the firearm would be discharged.”

“Decision Made Long Before The Event”

According to the court, Malema was aware of the risks associated with his actions and proceeded regardless.

Magistrate Olivier said:

“This decision was made long before the actual event. The accused knew it could cause harm to persons or property and yet proceeded.”

She added that such conduct could not be excused under any circumstances:

“Such acts cannot be condoned by this court in any instance, even if they occur in a celebratory context.”

The court further ruled that Malema is now unfit to possess a firearm.

Sentence Breakdown And Political Impact

The court handed down multiple penalties, with the sentences running concurrently. The primary sentence is five years’ direct imprisonment.

Additional penalties include:

  • Two years’ imprisonment on a related count
  • Fines of R20,000 (approximately US$1,050 / R20,000) on three separate counts, each with an alternative of six months’ imprisonment

Under South Africa’s constitutional provisions, any individual sentenced to more than 12 months without the option of a fine is disqualified from serving as a Member of Parliament for five years.

However, Malema’s legal team has indicated plans to appeal both the conviction and the sentence.

“We will be lodging an immediate appeal,” his legal representatives indicated in court.

Pending the appeal process, which could escalate to the Constitutional Court, Malema may remain free and continue serving in Parliament.

The case has drawn widespread attention due to Malema’s high-profile political position as leader of the EFF, one of South Africa’s major opposition parties.
